Merck Hit With Fosamax Lawsuit Forbes.com April 13, 2006
Drug maker Merck & Co. is facing more legal woes.
The company, which has been hit with almost 10,000 lawsuits over its pain reliever Vioxx, is the target of a new lawsuit that alleges Merck was negligent in promoting its osteoporosis drug Fosamax.
The lawsuit, which seeks class action status and was filed Monday in U.S. District Court in Fort Myers, Fla., charges that Fosamax is a defective product because it can cause rotting of the jaw bone (osteonecrosis), the Associated Press reported.
The suit alleges that Merck concealed and continues to withhold information about the drug's potentially serious side effects from physicians and patients.
In a statement, the company said that in all of its clinical trials of Fosamax, there were no reports of osteonecrosis of the jaw. While there have been reports of osteonecrosis in patients taking Fosamax, that doesn't mean the drug caused it, the statement added.
Fosamax is Merck's second best-selling drug, with sales last year of $3.2 billion, the AP reported.
