Several lawsuits allege that Fosamax is a defective medication. They state that the drug can cause Osteonecrosis of the Jaw (ONJ). These suits claim that the drug's manufacturer, Merck & Co, marketed and sold Fosamax as a safe and effective medication to treat osteoporosis. They also claim that Merck did not adequately warn users of its side effects.

Merck claims that clinical trials of the drug Fosamax showed no risk of ONJ. The link between bisphosphonates and ONJ has been known since at least 2001 when oral surgeons and dentists noticed the link between bisphosphonates and jaw bone decay. Initially, it they thought that the only patients affected were those who had taken the intravenous version of bisphosphonates – mainly cancer patients. Now it is evident that oral versions of bisphosphonates, like Fosamax can also inflict the disease ONJ. 

Though other pharmaceutical companies make oral bisphosphonates for osteoporosis, an FDA safety review showed that Fosamax led to a higher incidence of ONJ than the other drugs.

What is a Fosamax lawsuit?
A Fosamax lawsuit is a civil legal claim filed on behalf of those negatively affected by this product. A Fosamax claim is filed against Merck, the manufacturerers of Fosamax. A Fosamax lawsuit alleges that it the side effect outweight the intended benefits, and falls under the broad legal claim of product liability. A Fosamax lawsuit was filed on April 10, 2006 in a US District Court of Florida. The plaintiffs allege that Fosamax is a defective product that can cause osteonecrosis of the jaw. The suit also claims that Merck knew about this side effect and intentionally hid it from doctors and patients.

Additionally, the lawsuit claims that the manufacturer failed to add a warning about osteonecrosis of the jaw on the product labe, as per the FDA's instruction in August 2004.
